Resmed Sues 3B Medical, Inc.

Resmed Fights Patent Infringement

Resmed has filed a lawsuit against 3B Products, LLC. 3B is the American arm of Chinese manufacturer, BMC Medical Co., Ltd. California based Resmed is claiming that 3B Medical has infringed on its line of CPAP machines through the sale of the RESmart CPAP and Auto machines, or APAP machines, the Willow nasal pillows CPAP mask, and iVolve nasal mask. Essentially, this is the entire line of Sleep Apnea related products that is offered in the United States by 3B Medical, Inc. These filings were created in the International Trade Commission as well as U.S. federal courts, asking that these entities prevent 3B Medical from infringing on ResMed’s patents and award damages against 3B and the Chinese parent company. David Pendarvis, the ResMed global counsel and Chief Administrative Officer has stated,
“The proprietary technology in our masks and flow generators makes them comfortable and user-friendly, and our data management and reporting tolls create a faster, smoother path to patient engagement. We will continue to defend our proprietary technology by enforcing our patents against those who unfairly copy our products.”

3B Medical has stated that it intends to fight the lawsuit. ResMed has just won a previous lawsuit against APEX Medical, out of Taiwan. ResMed had similar charges against the Taiwanese company for infringement on CPAP related products.
